Adventures in Copyrights: On Your Marc

you're reading this and i'm on a plane.jpg
Reader Shannon writes in to say, “This new shoe from Marc by Marc Jacobs looks a lot like Vans to me. Or is it only egregious when the infringement is trickle-down?”

Well no, it’s not, but this definitely requires some discussion.

On the one hand, Marc and his team are clearly referencing Vans’ Old Skool style.

But it’s not like the Foley + Corinna knockoff dres, which looks exactly like the original.

Instead, it’s a nod to the skater and street community that Marc constantly references in his collections, sometimes blatantly (Stephen Sprouse graffiti prints), and sometimes a little more under-the-radar (like, did anyone else notice the Shepard Fairey kickback in his recent runway show?).

So some style fans might see this shoe as a clever, backhanded shout out to the kids who fuel Marc’s fun…

And some will think it’s just a glorified, overpriced Van (which, for the record, we wore every day in high school).

Care to choose sides?

Marc Jacobs designs shoes for Vans sometimes- could these be from his next collection for them?

that's just what i was thinking. but the stripe is wrong, and since the stripe is the trademark i would think the Vans people wouldn't want that messed with. Also there's no logo block on the back - which even the MJ Vans have. Maybe there was a falling out between MJ and Vans...
that's purely wild rumor-mongering on my part.
i'd rather buy regular Vans either way. i don't like it when designers make more expensive versions of familiar shoes. they just look like weird fake Vans to me.

Seriously, I think people only get upset when cheaper brands copy....usually way, way, way cheaper brands. At other times, most just let it go (speaking of which, has anyone noticed similarities between the Guess? and Prada logos?)

marc jacobs is doing another colaboration with vans to be launched soon. im sure vans appreciates the added sales and would let this vague reference slide.

This is just ridiculous. Everyone is getting so worked up over Forever 21 and their ilk, and yet when the situation is reversed, you don't express the same ire. You even used the phrase "nod to" which is just the most obvious substitution for "ripping off". If you're going to have such a strong stance on this concept, it would be a lot easier to swallow if it were truly across the board.

I agree with Marisa - IF it is indeed not from a Vans line but instead a "nod to" them, then every copy done by Forever 21 should be considered merely a "nod to" the original designer

way to double-standard

Marc already doesn't a limited edition for Van's. The Vans people are totally psyched. I thought this was supposed to be a fashion site?

mkm: the collabs are only $75. Even lucien pellat-finet's were that much. Are "regular" vans that much cheaper?

I'm with Marisa here. Not that I ever thought you position on copying was consistent or logical or reasonable.

But it can't be said enough.

Nod to = copy.

This illustrates the problem with applying strict copyright law to fashion. I agree with the nod = rip off. I also think it's probably best for everyone if people who want the cheap version (vans or f21) can buy that and the people that want a more expensive version (in this case the knock off) also have that option. The alternative will just make for fewer choices and worse fashion.
