Katy v. Katie

katyperrysushidress.jpgWe just came across this article on MTV (via The Australian) about a legal battle brewing between pop star Katy Perry and and Australian designer also named Katie Perry.

The “ie” Katie (born Katie Jane Perry) has been designing and selling a clothing collection online and in various locations in Oz for about two years. She filed a trademark application in September and was rightfully freaked out when she received a load of paperwork from a law firm representing the “y” Katy - asking her to withdraw her application and basically, from what we understand, stop using her own given name for her business.

This sounds absolutely absurd to us. It’s the girl’s name. And as designer Katie said to the newspaper, “”I love my business. I’m not going to give it away without a fight, either,” she said. “I’m not trying to become a singer. I’m not pretending to be her. This is my income. And it’s the livelihood of my contractors as well.”

While we’re not surprised that Katy Perry is seemingly batting around the idea of a fashion line (God help us all!), we don’t think she should be able to block anyone from using the name they were given just because she’s famous.

Fight the good fight, Katie! Maybe you’ll be able to save us all from sushi dresses.

I hate Katy Perry. Shes only famous cause she was banging that dude from that stupid Gym Class Heroes band. They're both abominations. Good luck to Katie J. Perry! I'm sure she's the more deserving and fashion forward of the two as well! =]

Katy Perry won't win! She changed her OWN name - her real given name is Katy (Katheryn) Hudson because she didn't want to be confused with Kate Hudson! What a hypocrite!

I am surprised you didn't mention this fact in your article.

all the teens love her and the songs are so catchy you must be like these bitter adults who couldn't do a thing in their lives.
Her fashion may be a bit funky but some of the things other designer design aren't grade A work either.
And she got famous from "I kissed a Girl" not by dating the gym class hero guy comment number two get your facts right!!!

I LOVE HER SONGS AND FASHION!!!!! the rest of you guys must be crazy and incase you didn't already know anna wintour offered katy and justin a cover on vogue and is still thinking about how to go about it.
So she must have some type of fashion and most girls now a day are also wearing the random designs on clothing.

whoa heated debate. #3 that's reaaally interesting and completely hypocritical of the singer. I agree that it's definitely unfair to try and stop someone from using their own legal name, and that adds a whole nother layer. I find some of her songs catchy, but Anna wanting to put her on the cover of Vogue? Sure she's had Blake Sienna Reese but I don't know if I can believe that. Where did you read this?

I hate Katy Perry's music. It's like nails on a chalk board to me. I think her tunes have no redeeming quality. I never disliked her personally but this little lawsuit does make her come across as a total ass.

I highly doubt the United States Patent and Trademark office cares who a trademark applicant bangs to get famous. The Katies will battle it out and see what makes the most sense to protect consumers' expectations. That's what trademark law is about. Nobody has the "right" to trademark protection without going this route, and both sides get a say.

Ok, sigh. I think Katy Perry is being a total jerk, and probably just IS one, all the time, but I also think improper word use is a real shame, so I would just like to point out that the fact that Katy Perry changed her name to NOT be confused with Kate Hudson is actually the opposite of hypocritical, because she actually did the thing she is (wrongly) expecting someone else to do. She would be a hypocrite, if, say, someone suggested she change her original name and she said, "eff it, I am a singer, not an actress, and it is my name, too, so I am keeping it," and then expected this designer to change her name for essentially the same reason she was told to, but then did not.

Like I said, KP appears insanely egomaniacal, but the term "hypocrite" is almost as woefully misused as the word "ironic", so I thought I would try to save it, one nerdy correction comment at a time!

Katy Perry changed her name to stop herself being confused with Kate Hudson and 'Perry' was her choice. She can't then expect someone else whose REAL name is Katie Perry to do the same. It's absurd. Besides the fact that this girl has been doing her business for 2 years, it's an incredibly selfish move. And yes you're right about the hypocrite part. I couldn't think of the right word. I still can't. I'm just going to go with what a bitch!

I'm not a lawyer, but I'm pretty sure that this would get thrown out of court if it got that far.

The y/ie disparity is probably enough to differentiate the two brands.

And speaking as someone from Queensland, most lawyers from that state are wankers.

Still, I guess it goes to show: if you're going to trade under your real name you should probably trademark it early, and trademark it everywhere.

(and for the record, I really like Katy Perry as a singer, but I really hope that she's not the driving force behind this ridiculous case)

That's really shitty! Katy Perry isn't even her real name. Katie was born Katie Perry, so she was Katie Perry FIRST, she shouldn't have to change it. Katy Perry's being a selfish b**ch! Just because apparently her real name wasn't goood enough, she's causing trouble for someone who is fine with her given name and wants to use it.

What a liar that girl is! We're all online and it's easy to look stuff up! I just looked up typecast in Webster's dictionary online - it's from 1927, not the 1800s:
