Adventures In Copyright: A Rose By Any Other Name

I thought you guys might want to take a look at this copy of Valentino’s Rose Bag by some company called Big Buddha that I found on Piperlime. Not that it looks even close to as lovely, but it’s blatant.

Plus it was even a Rachel Zoe pick. I die. Do you think it will end up in her “Alternate Universe” on The Zoe Report? I bet it might.

Anyway, just thought I would point it out. Happy Thanksgiving!

I HATE knockoffs and retail companies that choose to imitate more expensive designer goods. They should spend their energy coming up with stylish alternatives to high priced items rather than copying from others. (I'm also a lawyer so I find the offense doubly despicable.)

Yes it's a blatant copy but at the same time I'm not sure it's fair to get all huffypants with Big Buddha, because I have seen the rose detail knocked off EV-rywhere lately. Seriously: EVERYWHERE.

Also, I am about 100% positive that if we had a wayback machine we could find this bag in the 1980s, so I'm not going to gush over Valentino's allegedly unique design here.

good call diva deluxe! i knew i'd seen this shape somewhere else before. i wish these "copyright" posts would go in another direction, like showing where the idea first started and how it trickles down. that would be a much more interesting read then expensive is right, cheaper is evil angle they always go for.
just my two cents.

The silhouette isn't the same, and I'm quite sure that the rose bag was around more than 3 or 4 years ago.

Eh, maybe not a very creative design, but not a knock off.

This may have been said before but the fact is that fashion designs are NOT protected under copyright law. For one, copyright protection is valid for the life of the author plus 75 years which is an extensive period of time while fashion trends change seasonally. So there is an issue with giving such expansive protection for something with such a short lifespan. Second, clothing does not fall under copyrightable subject matter as it is currently described in our statutes.

So, sorry.
