Marc Jacobs has sued Ed Hardy over the quilted nylon bag at left.

It’s been a Marc by Marc staple for a few years now, but Ed added it to his “collection” in 2009.

He’s copied the size, the shape, the color (Marc’s comes in seafoam green, too), the embroidery, the handles, the side pockets and the plaque in the center. In fact, if Christian Audiger hadn’t made the bag even uglier by adding images of jumping fish – it might be one of the most identical copies we’ve ever seen.

The suit was filed in Los Angeles and says, “Defendants have committed and continue to commit their wrongful acts with the willful and deliberate intent to deceive consumers, to cause confusion and mistake, and to interfere with consumers’ ability to identify the source of Defendants’ Infringing Products by the appearance of such products’ trade dress which imitate Plaintiff’s authentic Marc Jacobs Pretty Nylon Tote Trade Dress, and by use of a mark confusingly similar to the Marc Jacobs Scrambled Trademark.”

You're right, they definitely knew what they were doing. And all over that of all bags?! I can't say that I am a fan of the MJ, but EH managed to make it significantly less appealing.

Wow, those are both hideous. Wasn't that Marc Jacobs who pretty much ripped off the Tiffany airplane keychain recently?

Yeah, Marc definitely deserves a couple of trademark infringement suits coming his way too, but I'm in support of anything that will diminish Ed Hardy's presence in the world. The settlement should just be that Christian Audiger should have to dissolve the brand.

He blatantly plagiarized a design printed one of his scarves, too.

Totally agree! Who buys such ugly ass stuff – and I think it's only popular on the West Coast. I don't get it's appeal.

Don't point fingers at the West Coast. Last I checked, it was Madonna and other major celebs wearing the brand AND the entire cast of “Jersey Shore”.
I think it just makes people annoyed because Christian Audiger is banking off of this weird fashion phenomenon.
